ACCOMMODATION – means the provision of a space consisting of a studio, apartment or rooms located in family homes, personal property or tourist reception structures, available to be made offered by the host to a guest for a certain period of time.

HOST – the person who holds the right to make an Accommodation available to guests and who presents the services offered on it through com, following the conclusion of a contract with the Administrator.

GUEST – the person who chooses to be the beneficiary of renting an accommodation for a certain period of time against a sum of money paid to the host.

DOCUMENT – these Terms and conditions.

SITE – the com domain and its subdomains or any application associated with the KeyStay.com website.

USER – any person who accesses this Site for any reason or uses the services offered through the Site on the basis of an account, including to post content as well as to download, use, copy a part of or all of the documents/information found on this Site.

ACCOUNT – the ensemble made of an email address and a password that allow a single user access to restricted areas of the site through which access to the service is made.

SERVICE – providing members or different accommodation and booking platforms based on an account with access to existing information and services and facilities in KeyStay.

MEMBER – any major person who has the right to access the KeyStay Service through an account.

CONTENT – any information on the Site or available in the Service that can be viewed or accessed by the User through the use of electronic equipment.

KEYSTAY – the online platform available at the com domain that allows each host to promote to the users of the site the accommodation spaces available for reservation and through which guests can make these reservations, entering into a direct contractual relationship with the hosts where they make the reservation.

For the avoidance of doubt, the Administrator expressly states that it is not a tourist service agency, but only an intermediary between the guest and the host, sending the booking details to the host and a confirmation email on its behalf. Our confirmation is based on the information that the host makes available by posting on our website.

Accordingly, the hosts are solely responsible for updating the information regarding prices, availability, service level and other information that is published on our website. The Administrator is not responsible for the content posted on the Site by the hosts, for the host’s compliance with the existing legislative obligations regarding the short-term rental of residential housing or the laws governing the tourism activity, the copyright of a third party, unfair competition or false advertising. However, the administrator of this site will take remedial measures whenever it is notified about the display of information that does not conform to reality.

By making a reservation with a host, the Guest accepts and agrees to the cancellation and no-show policy of that host and any other terms and conditions of delivery that may apply to the reservation or stay, including the services or products offered by the host. The general cancellation and no-show policy of each host is available on the Site on the information page of each Accommodation Area, during the booking procedure and in the confirmation email.

The Administrator is not responsible for damage or destruction caused to any accommodation, damage to personal property or injury to persons either host, guest or guest.

Also, the Administrator is not responsible for the host’s fulfillment of tax obligations in relation to the income obtained.

The Administrator will make the necessary efforts to achieve the purpose of the site and has no responsibility for the content posted by users within the services.

The Administrator will make technical efforts to ensure the proper functioning of the site. In the event that there will be interruptions in operation or impossibility of access by users for a specified period of time, the Administrator will not be liable to any person for any damage or loss suffered, resulting directly or indirectly as a result of improper use of the Service provided, Failure of the Service for technical reasons and/or as a result of the action of third parties.

Content of the Site (except content posted by hosts on the Services), including without limitation all graphic text and images, buttons, symbols, web graphics, scripts, programs and other data, As well as the KeyStay® brand are the exclusive property of the Administrator or its suppliers and are protected by the Copyright and related Rights Act 8/1996 and the trademarks and geographical indications Act 84/1998.

Users may use the content of the site exclusively for informational, non-commercial or personal purposes, and they are prohibited from copying, taking over, monitoring (spider, (b) reproduction, publication, transmission, sale, Partial, full or modified distribution of the content of this Site for other purposes, unless permitted by exceptions to applicable copyright laws or express agreements by the Administrator. Members may download the content to which they have access based on the account, but only for their personal use, any other use being conditioned upon obtaining the prior consent of the Administrator.

Users who publish/transmit any content on the Site or through it have the obligation not to prejudice in any way the copyright of a third person.

Access to the KeyStay.com Services will be allowed only to members, following the opening of the account and acceptance of the terms of use set forth in this document. In order to benefit from the KeyStay.com services, you must be an adult, according to the legislation in force.

Any inclusion of links to other sites or communication networks is made solely for the User’s help and does not imply any support by the Administrator of the material available within the aforementioned sites or networks, nor any association with their operators. Accessing those sites and using/purchasing the products and services offered by them will be done exclusively at the users’ own risk.

ISSUES RELATED TO THE SECURITY OF MEMBERS’ IDENTIFICATION DATA

The use of the services offered through KeyStay.com requires the creation of an account, and, where applicable, the provision of current, complete and accurate information within the applicable registration form existing in KeyStay. Information on data subjects will be processed in accordance with the Privacy Policy.

The user thus registered becomes a member and is responsible for maintaining the confidentiality of account information and password and for all activities that take place within the respective account.

The Member is entirely responsible for all activities and information that is transmitted from the account allocated to him, not having the right to allow another person to use that account.

The administrator assumes no responsibility for any consequences arising in the event of unauthorized access to the account by third parties for any reason.

For the functioning of the Services, it is necessary to communicate to the Administrator some true and correct information, the Administrator implementing technical measures to preserve the confidentiality and security of the personal data existing in KeyStay, such as:

-user and password-based access;

-the association of user-appropriate profiles;

-filtering of application functionalities and data displayed according to the user profile;

-access passwords are not displayed in the application;

-the user logged in and without activity for 20 minutes is automatically logged out of the application;

-all operations performed on the database are logged and archived.

Any member is obliged to notify the Administrator as soon as possible of any inadequacies in his/her personal profile, or unauthorized, improper or illegal use of his/her password or account or any other security issue.

The administrator may make discussion forums, chat rooms or other communication platforms available to users.

Any communications between users on the Site must comply with the following limitations:

-To not contain any form of advertising to various categories of goods or services;

-to not contain threatening, false, misleading, abusive, libelous texts, vulgar, obscene or infringing copyright

-to not be discriminatory;

-to not contain any personal data from users.

The restriction of access of the host member to the Services shall take place by law on the date of termination for any reason of the contract concluded with the Administrator.

The administrator has the right to terminate your account or to stop the ability of using the Site at any time for good reason, including without limitation the following reasons: Breach of these Terms and conditions, lack of activity on the Site or if the Site is no longer managed by Administrator.Keystay.com may, on its own initiative, terminate your account or  block your access to the Services for any reason that may include a lack of activity on the Site or a conscious or unconscious violation of these policies. Keystay.com may discontinue the provision of the Services without prior notice. You agree that keystay.com may delete or partition your account, with all the files it contains. However, keystay.com cannot guarantee that all information posted on the site will be deleted. Keystay.com does not answer to you or any other entity for the termination of the provision of services

Romanian law governs the terms, conditions, and use of this Site. By using it you agree to the jurisdiction of the courts with territorial and material jurisdiction in connection with any legal action arising in connection with the provisions of the Terms of use and/or the content of the site.

If any provision of this document or its application to any part or circumstance is limited, prohibited or unenforceable, such provision shall be deemed unwritten, without invalidating the other provisions of this document, without affecting the validity or enforceability of other terms and without affecting its application to other parties or circumstances.
